Public Offer.

This document constitutes a Public Offer (hereinafter — the "Offer") from Swell Games, TOO(BIN: 251140032034), registered in the Republic of Kazakhstan (hereinafter — the "Company"), addressed to any individual or legal entity (hereinafter — the "User") regarding the purchase and use of the Flash7X mobile application (hereinafter — the "Application"). This Offer is made in accordance with the civil legislation of the Republic of Kazakhstan.

1. Acceptance of the Offer

Full and unconditional acceptance of this Offer (Acceptance) is deemed to occur upon any of the following actions by the User:

• — Initiating a subscription purchase through the Apple App Store;
• — Initiating a subscription purchase through the Company's website at www.flash7x.app;
• — Installing or using the Application.

By accepting this Offer, the User confirms that they have read, understood, and agreed to all its terms. The User also agrees to the Terms of Service and Privacy Policy, which form an integral part of this Offer.

2. Subject of the Offer

The Company grants the User a limited, non-exclusive, non-transferable, revocable license to use the Flash7X mobile application on Apple iOS devices, subject to the terms of this Offer. The Application provides filmic color science processing, GPU-accelerated photo capture, and a curated photographic experience. Access to full Application functionality requires an active paid subscription as described in Section 4.

3. Parties to the Agreement

Depending on the purchase channel, the User enters into a purchase agreement with different parties:

• — App Store purchases: The User transacts with Apple Inc. under Apple's Media Services Terms and Conditions. Swell Games, TOO is the developer and licensor of the Application.
• — Web purchases: The User transacts with our payment provider Polar Software, Inc. ("Polar", polar.sh), acting as the Merchant of Record and reseller of the product. Polar processes payments, issues receipts, and handles applicable taxes. The User agrees to Polar's Terms of Service for web purchases.

4. Pricing and Payment Terms

The Application is available under the following subscription plans:

• — All prices are stated in US Dollars. Applicable local taxes may be added at checkout depending on the User's jurisdiction.
• — Payment is charged to the User's Apple ID or selected payment method at the time of subscription initiation and upon each automatic renewal.
• — The Company reserves the right to change subscription pricing. Price changes will be communicated in advance and will take effect at the next renewal period.

5. Automatic Renewal and Cancellation

• — All subscriptions automatically renew at the end of each billing period until cancelled by the User. App Store subscriptions must be cancelled at least 24 hours before the renewal date; web subscriptions may be cancelled at any time, effective at the end of the current billing period.
• — App Store cancellation: Settings → [Your Name] → Subscriptions → Flash7X → Cancel Subscription.
• — Web cancellation: Via the Polar Customer Portal, also linked in every email Polar sends (order confirmation, renewal notices). The User signs in with the purchase email address and confirms with a one-time code.
• — Cancellation stops future renewals. The User retains access to the Application until the end of the current paid billing period. No partial refunds are issued for unused portions of a billing period.

6. Refunds

Refunds are governed by the applicable purchase channel:

• — App Store purchases: Refunds are processed exclusively by Apple at reportaproblem.apple.com.
• — Web purchases: A 30-day money-back guarantee applies. Refund requests must be submitted within 30 days of purchase to support@flash7x.app. Approved refunds are issued through Polar to the original payment method, including applicable taxes.

7. Intellectual Property

All rights in the Application, including but not limited to source code, Metal shaders, color science algorithms, visual design, and branding, are the exclusive property of Swell Games, TOO and are protected by applicable intellectual property law. The User receives only the limited license described in Section 2. Nothing in this Offer transfers ownership of any intellectual property to the User.

8. Limitation of Liability

The Application is provided "as is". The Company does not warrant uninterrupted or error-free operation of the Application. To the maximum extent permitted by applicable law, the Company's aggregate liability to any User shall not exceed the total amount paid by that User for the Application in the 12 months preceding the claim.

9. Validity Period and Amendments

This Offer is valid from the date of its publication on www.flash7x.app until revoked by the Company. The Company reserves the right to amend this Offer at any time. Amendments take effect upon publication. Continued use of the Application after amendments constitutes acceptance of the updated Offer.

10. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under this Offer where such failure or delay results from circumstances beyond the Company's reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental action, power or internet outages, or failure of third-party services (including Apple App Store or Polar). In such circumstances, the Company's obligations shall be suspended for the duration of the force majeure event.

11. Governing Law

This Offer and any disputes arising from it are governed by the laws of the Republic of Kazakhstan. Any disputes shall be resolved in the courts of Astana, Kazakhstan, unless mandatory consumer protection laws in the User's jurisdiction require otherwise. The User agrees to first attempt informal resolution by contacting support@flash7x.app before initiating formal proceedings.
